Terms and conditions of enrolment

Please read these terms and conditions carefully as they shall form part of the contract between the student and, where applicable, the person responsible for the fees and Cambridge Arts & Sciences Limited (“the School”). It is important that you make sure that you have read and understood all of these terms and conditions as you will be deemed to accept them when you sign the application form.

1 Application and registration
1.1 The student registration form must be signed by the student and (where the student is not the person paying the fees) by the person responsible for the fees who must guarantee payment of all fees and disbursements as they fall due and indemnify the School in respect of any additional costs, damages or other liabilities, however arising, caused by, or attributable, to the student. In all cases, the registration form should be returned to the Registrar, at the address indicated on the forms, together with the Registration Fee of £100 and the School Deposit of £900, making £1,000 in total.
1.2 The communication of acceptance in writing by the School of a student’s registration form and attached materials constitutes the reservation of a place at the School.
1.3 Once the registration form is submitted by the student, he/she will have seven days in which he/she may notify the School in writing, via the Registrar, that the registration form is to be cancelled or withdrawn. In the event of cancellation or withdrawal, all fees and deposits submitted with the registration form will be returned to the student or person responsible for the fees as the case may be, however, a charge of £100 plus any applicable bank charges will be deducted by the School from these funds to cover administration costs.
1.4 In order to withdraw a registration which has been accepted and not withdrawn under 1.3 above, the person responsible for the fees must provide six weeks’ notice, in writing, prior to the commencement of the proposed course of studies. Failure to give such notice within the period indicated will oblige the person responsible for the fees to pay the School term’s fees in lieu.

2 Deposits
2.1 The deposit that is required by the School cannot be refunded until the final account has been settled in full, at the end of the student’s course of studies. Only once a student’s account has been fully settled will any remaining deposit funds be returned to the student or person responsible for paying the fees, as applicable, where such funds shall be applied to the account the deposit was originally drawn upon, unless otherwise advised in writing by the person who provided the deposit.

3 Fees and expenses
3.1 All tuition and accommodation fees are payable termly, in advance of the start of the academic term, and in accordance with the term dates published, as amended from time to time. Alternatively the fees can be paid annually by a single advance payment, and this protects the person responsible for the fees from any fee increase which may be made during the pre-paid portion of the programme.
3.2 Invoices are due for payment within 14 days of issue or the course commencement/January payment date, whichever is the latter.
3.3 All other fees and student expenses and disbursements are payable within 14 days of date of the invoice. Interest will be charged at the rate of 2% per month on all overdue balances until payment is made in full.
3.4 The student and person responsible for paying the fees undertake joint and several liability for all fees and other costs incurred, and accept a continuing obligation to meet any financial liability (for example fees, deposits, disbursements and damages) to the School, regardless of the student’s absence or withdrawal as described in these terms and conditions. The School reserves the right to discuss with students their fees and expense accounts in appropriate circumstances.
3.5 The School reserves the right to increase the fees at any time but fee increases will not apply in cases where the fees have already been paid.
3.6 Cash advances may be made to students out of cleared funds lodged with the School for this purpose:
3.6.1 but only in accordance with specific written instructions from the person lodging such funds as to their use; and
3.6.2 provided always that all of the School’s fees and expense accounts have been settled in full. The School will retain any interest accruing in this regard in lieu of administrative charges for providing this service. The School accepts payment in pounds sterling only by cheque, bank draft, direct credit, bank transfer, Visa or MasterCard. Further details on credit card payments are available from the Bursary. Please ensure that the student’s name and account number appear on all such payments. Any bank charges or commissions shall be payable by the sender of the funds. The School reserves the right to apply any unidentified general payments made on a student’s account to the oldest invoices first and then to subsequent invoices for the remainder of the payment made.

4 Student absences from studies
4.1 The School is unable to refund fees where a student is temporarily absent from his/her course of studies. As a result, none of the fees paid for the term in question will be refunded (fees paid for subsequent terms will be refunded), unless there are exceptional circumstances presented which would warrant consideration by the School.
4.2 The student and the person responsible for the fees should note that the School will automatically include all students, subject to acceptance by our insurers, in the “School Fees Insurance Scheme”. Further details of this insurance scheme are attached and are available from the School Bursary.
4.3 In order to qualify for acceptance in the School Fees Insurance Scheme, the School must be notified of any illnesses or pre-existing conditions from which the student suffers. The registration form should be used for this purpose.
4.4 In the event that illness or other circumstances will result in a student being absent for an extended period of time, the student should consider withdrawing from a course of studies, even if only on a temporary basis. Please let the School know as soon as possible if a student will need to withdraw in order to try to minimise the impact on the student’s academic progress. The conditions for withdrawals are described below in clause 5.

5 Student withdrawal
5.1 In order for a student to withdraw from a course of studies, or part of a course of studies, a full term’s notice in writing is required to be made by the student (where the student paid the fees) or, the person responsible for the fees, as applicable. Failure to give such written notice will oblige the person responsible for the fees to pay the School a term’s fees in lieu. In exceptional circumstances, the School will consider all facts as presented at the time of withdrawal in determining whether to waive part of the full term’s notice requirement.

6 Withdrawal required by School
6.1 All students are required to abide by the School’s rules as set out in the prospectus and the Student Handbook, as published from time to time. The School reserves the right to require a student’s immediate withdrawal from a course of studies, or part of a course of studies, for any grave disciplinary offence, or if it is considered by the School that such a withdrawal is in the best interests of the student, other students, and/or a study group. A review process will be undertaken by the School to ensure that any action taken by the School is fair and appropriate. In the event of a student’s withdrawal, no refund of the relevant term’s fees will be made. Please refer to the Student Discipline Policy and Student Handbook for further details.

7 Academic performance
7.1 Students are accepted at the School on the understanding that their progression through the relevant Programmes will be conditional upon them satisfactorily attending lessons and making reasonable academic progress.
7.2 If, in the reasonable opinion of the School, students have not satisfactorily attended lessons and/or made reasonable academic progress, the School may not enter them for public or internally accredited examinations or allow them to continue with the Programmes for which they enrolled. In such circumstances they will be offered suitable alternative Programmes or asked to withdraw from the School.

8 Accommodation
8.1 While the School will use its reasonable endeavours to provide a student with the accommodation requested on the registration form, such accommodation may not be available at the time of enrolment. In such cases the most suitable alternative accommodation will be provided at the appropriate charge and the person responsible for the fees will be invoiced or credited accordingly.
8.2 All students will be required to sign an occupancy agreement provided by the School prior to occupation of the accommodation.
8.3 Students who wish to change or move out of School Lodges must give six weeks’ notice in writing or they will be charged the normal accommodation fees in lieu of notice.
8.4 Students who wish to change or move out of Homestay accommodation must give four weeks’ notice in writing or they will be charged the normal accommodation fees in lieu of notice.
8.5 Changes in accommodation may only be made with prior written approval from the School.

9 General conditions
9.1 The School shall not be liable for either death or personal injury suffered by any student, except as may arise through the negligence of the School.
9.2 The School reserves the right, while respecting the privacy of its students, to employ such measures as may from time to time be felt reasonably appropriate for the maintenance of the standards of behaviour required by the School and by law.
9.3 The student and the person responsible for paying fees are liable for any damage the student causes to any School property or premises.
9.4 The School does not accept responsibility for students’ personal property, and students are advised to take out personal insurance to cover any loss or damage to personal property which may occur while they are at the School.
9.5 The School reserves the right to use students’ details and achievements for promotional purposes with the prior consent of the students or their parents or guardians.
9.6 The School will use all reasonable endeavours to deliver the course of studies in accordance with the descriptions set out in the published material. However, in the context of the provision of a diverse range of courses to a large number of students, the School reserves the following rights:
9.6.1 To alter the content or method of delivery, nature or venue and to discontinue courses and to move and/or combine courses in any course of studies at any time;
9.6.2 To alter any of the details of published information at any time;
9.6.3 To assign the whole or part of the agreement(s) between either the person responsible for the fees and the School or the student and the School, to any person, at any time.
9.7 If any changes are made by the School in respect of either 9.6.1) or 9.6.2) above, the School will make every attempt to provide the student with reasonable notice. It is the student’s responsibility to review regularly the School’s website for any such notices, or other locations as directed by the School.
9.8 No contract or agreement with the School confers rights under the Contracts (Rights of Third Parties) Act 1999 on anyone else except the parties to the contract or agreement, and the parties do not intend any terms of any contract to be enforceable by any third party.
9.9 The student or the person responsible for the fees should contact the College Bursary (++44 (0)1223 314431) if there are any questions regarding fees or other financial information.

10 Consequences of late or non-payment of fees
10.1 Without prejudice to the School’s right to collect fees in any way it deems fit, the School reserves the right to take any or all of the following actions in the event that fees or other payments due to the School are in arrears and to maintain these actions until all fees are paid in full:
10.1.1 Not submit exam entries for the student;
10.1.2 Withhold Examination Certificates;
10.1.3 Withhold Academic References;
10.1.4 Withhold Certificates of Attendance;
10.1.5 Withdraw the student from School accommodation; and
10.1.6 Withdraw the student from a course of studies. While the School recognises that the above actions may disrupt a student’s course of studies, the School does not accept any responsibility or liability for any disruptions so caused.

11 Jurisdiction
11.1 These terms and conditions, and any disputes arising from contracts or agreements with the School shall be governed by and construed in accordance with English Law under the non-exclusive jurisdiction of the English Courts.
